1. SUBJECT MATTER

Conditions regarding participation at Events organised by Pictoplasma, such as the “PICTOPLASMA CONFERENCE” or “PICTOPLASMA ACADEMY”.

The following general terms and conditions apply to the contractual relation between the organizer (Pictoplasma) and the participant of the Event. The terms and conditions are only available in English. The terms and conditions do not apply to the sales of books and other goods on our website, which are subject to a special Terms and Conditions of Sale – Books and Products.

3. PRICE / PARTICIPATION + REGISTRATION FEE

All prices on the event’s website are displayed in EURO or USD and include legal VAT

 

4. ACKNOWLEDGEMENT OF REGISTRATION, CONFIRMATION OF PARTICIPATION, TICKETING

Once the online registration payment has been received, a confirmation of the registration (including an unique registration code) will be sent to the email address of the participant.

The participant shall save and/or print out the confirmation email (especially the unique registration code) and bring it along with a valid ID. Physical ticket/s will be available directly at the event venue. With the effective payment of the relevant ticket price the participant has all rights described below.

 

5. SERVICES INCLUDED

The ticket price covers full access to all of the event’s happenings as described on the website, (incl. lectures, screenings, workshops and presentations).

 

6. NOT INCLUDED

Travel, accommodation, food and drinks are not included in the price. Each participant has to defray his/her costs and additional expenses.

 

7. EXCLUSION OF LIABILITY

The organizer shall not be liable for any damage to property and other subjects. With regards to essential obligations any negligence leads to the liability of the organizer. The exclusion does not apply to the liability regarding personal damage and to any damages caused by the organizer intentively or with gross negligence.

 

8. PAYMENT

Tickets can be purchased on the organizer’s website by credit card via the services of PayPal (USA) or Mollie (NL).

 

9. INVOICES

The confirmation sent by email after registration and payment is the invoice.

 

10. CANCELLATIONS, SUBSTITUTIONS & REFUNDS

Tickets are generally not refundable once purchased.

A participant, who is unable to attend the event, may name a substitute in writing up to 5 days prior to the events scheduled beginning.
The participant shall direct the written revocation towards the organizer (see 2.) with the following information:
Participant’s name, registration code/invoice number and e-mail address, as well as the name and e-mail address of the person who will now be attending in participant’s place.

Not withstanding the provision regarding the right of revocation: The organizer must be notified of any cancellations at least 8 weeks prior to the event’s scheduled beginning.
In some cases payment may be refunded minus a 50,- Euro administration fee.
Cancellations made later than 8 weeks prior to the events scheduled beginning, as well as attendees who fail to attend, will not be refunded.

 

11. FORCE MAJEURE

If the Pictoplasma Event is cancelled by the organizer, the organizer will fully refund the registration fee with no penalties or other reductions.

However, the organizer shall not be liable for cancellation of the event if such cancellation is as a result of “Acts of God” (including fire, flood, earthquake, storm, hurricane or other natural disaster), epidemics or pandemics, war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service (Force Majeure).

The organizer is not responsible for travel expenses or penalties under any circumstances.

 

12. SPEAKER LINE-UP, FEATURED ARTISTS AND SCHEDULE

While all featured artists have confirmed their participation, the organizer can not guarantee that the artist list or schedule is fully final. Featured artists and schedule are subject to change without notice.

 

13. DATA SECURITY

Datas of the participants will only be used for the purpose of registration / participation of the pictoplasma conference. Our data security practice is in accordance with the federal data protection law (BDSG) as well as with the tele service data protection law (TDDSG).

 

14. APPLICABLE LAW

To all disputes deriving from these terms and conditions and the participation of the event (regarding tickets, access etc.) German law is applicable.

 

15. JURISDICTION

All disputes arising from this terms and conditions and the participation to the conference are subject to the jurisdiction of the organizer`s principal place of business, Berlin, Germany.

 

16. MISCENELLOUS

Every provision of these terms and conditions is independent and valid independently from the validity of the other provisions.
If a provision should be invalid, it shall be replaced by a provision which corresponds to the presumed corresponding intention of the concerned parties.

This Privacy Policy sets out the data processing practices carried out by Pictoplasma, Denicke & Thaler GbR in relation to information provided by you on this website. If you have any queries concerning your personal information or with regard to these practices please contact us.

INFORMATION COLLECTED
Like most website operators, Pictoplasma collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. In order to do so, we use the open source software Piwik (Matomo.org).

Our purpose in collecting non-personally identifying information is to better understand how you, our visitors, use our website. Pictoplasma collects information on the use of the website by using session-cookies. Session-cookies help Pictoplasma to enable the use of the website and improve services by making the services more user-friendly.

Additionally, we collect personal information from visitors to our website through the use of online forms (when a user registers for the conference or orders in our online webshop) and every time you send us an email via our contact form, in order for us to email you back.

USE OF PERSONAL INFORMATION
We process personal information collected via this website to enable us to fulfil your orders and operate your account with us. We keep a copy of the information you provide to us for our internal purposes (for example to register you at the Conference or ship you your order).

OUR NEWSLETTER
If you would like to receive our newsletter, we obviously need your email address in order to do so. We use the so-called double opt-in procedure to ensure that newsletters are sent in a consistent manner. This way the potential recipient can be included in a distribution list. After the registration, the user receives a confirmation email to confirm. The address is only actively included in the distribution list if the registration is confirmed.
We use this data exclusively for sending the requested information and offers.
Newsletter2Go is used as our newsletter software. Your data is transmitted to Newsletter2Go GmbH. Newsletter2Go is prohibited from selling your data and from using it for purposes other than sending newsletters. Newsletter2Go is a certified German newsletter software provider, working in accordance with the European directive 95/46, as well as the German Federal Data Protection Act (BDSG).
